Note for the Loyalito team: plain-language terms reflecting how the product works today. Have them reviewed by a lawyer and add your registered entity, company number, registered address and governing jurisdiction before launch.

1. Who this is between

These terms govern use of Loyalito by a business (“you”) and are agreed when you create an account. If you are agreeing on behalf of a company, you confirm you are authorised to do so.

2. The service

Loyalito provides digital loyalty cards for Apple and Google Wallet, tools to enrol and reward customers, and marketing features including AI-assisted campaigns. We may add, change or remove features; if a change materially reduces what your plan provides, we will tell you before it takes effect.

3. Trial and billing

4. Plan limits

Each plan includes limits on customers, staff seats, locations and monthly messages. If you exceed a limit we will tell you and ask you to upgrade rather than cutting the service off mid-service.

5. Your data and your customers

Your customer list and the content you create remain yours. We process them to run the service on your instructions, as set out in the privacy notice. You can export your data at any time, and we will delete it on request.

You are the data controller for your loyalty members. You are responsible for collecting valid consent, for the content of campaigns you send, and for complying with marketing and privacy law in the countries you operate in.

6. Acceptable use

You agree not to use Loyalito to:

We may suspend an account that does these things, with notice where it is safe to give it.

7. Availability

We aim for continuous availability but do not guarantee uninterrupted service. Planned maintenance is announced in advance where practical. Wallet pass delivery and push notifications depend on Apple, Google and network operators, which are outside our control.

8. Liability

To the extent permitted by law, our total liability in any twelve-month period is limited to the fees you paid in that period. We are not liable for lost profits, lost revenue or indirect losses. Nothing here limits liability that cannot be limited by law.

9. Ending the agreement

You may close your account at any time. We may end the agreement with 30 days’ notice, or immediately for a serious breach of section 6. On termination you can export your data for 30 days, after which it is deleted.

10. Changes and contact

We will give reasonable notice of material changes to these terms. Questions: hello@loyalito.space.
